Terms of Service

1. Acceptance of Terms
Welcome to Hearo ("Hearo," "we," "our," or "us"). By creating an account or using the Hearo mobile application and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use the Service.
These Terms constitute a legally binding agreement between you and Hearo. We reserve the right to update these Terms at any time. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.
2. Eligibility
You must be at least 13 years of age to use the Service. By creating an account, you represent and warrant that you are 13 years of age or older. We collect date of birth during registration and block account creation for users under 13. If we discover that a user is under 13, we will terminate their account and delete their information.
In certain jurisdictions, the minimum age may be higher under applicable law. You are responsible for ensuring your use of the Service complies with the laws of your jurisdiction.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hearo.help@gmail.com if you suspect any unauthorized use of your account.
You agree to provide accurate and complete information when creating your account and to keep your account information up to date. You may not impersonate another person or use a username that is offensive, vulgar, or otherwise violates these Terms.
If you choose to add a phone number to your Hearo account, you consent to receive a one-time SMS message containing a verification code for the purpose of confirming your phone number. Message and data rates may apply. This is a one-time transactional message, not a recurring marketing message, and you are not enrolled in any ongoing SMS program by adding your number.
We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in conduct we determine to be harmful to the Service or other users.
4. User Content
The Service allows you to post ratings, reviews, comments, messages, images, and other content ("User Content"). You retain ownership of your User Content.
By posting User Content, you grant Hearo a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, distribute, and modify your User Content solely for the purpose of operating and improving the Service.
You represent and warrant that your User Content does not violate any third-party rights, including intellectual property rights and privacy rights, and that it complies with these Terms and all applicable laws.
5. Prohibited Conduct
You agree not to use the Service to:
- Post content that is unlawful, harassing, abusive, threatening, defamatory, obscene, or otherwise objectionable
- Post content that infringes any patent, trademark, trade secret, copyright, or other intellectual property right
- Post content that contains nudity, graphic violence, or sexually explicit material
- Harass, bully, or intimidate other users
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Use the Service for any commercial purpose without our prior written consent
- Attempt to gain unauthorized access to any part of the Service or its related systems
- Use automated means to scrape, crawl, or extract data from the Service
- Upload or transmit viruses or any other malicious code
- Violate any applicable local, state, national, or international law or regulation
We reserve the right to remove any User Content and suspend or terminate any account that violates these Terms.
6. Music Services and Third-Party Integrations
The Service integrates with third-party music platforms including Apple Music and Spotify. Your use of these integrations is subject to the respective terms of service and privacy policies of those platforms. Hearo is not responsible for the availability, accuracy, or content of third-party services.
You represent that you have the right to connect your Apple Music or Spotify account to the Service and that doing so does not violate any third-party terms or agreements.
7. Direct Messages and Group Chats
The Service includes direct messaging and group chat features. You may only initiate a direct message with a user who mutually follows you. Group chats are exempt from this requirement; any user may be added to a group chat by an existing participant, regardless of follow status. By using these features, you agree not to send unsolicited messages, spam, or any content that violates these Terms. We reserve the right to review and remove messages that violate these Terms and to terminate accounts engaged in abusive messaging behavior.
8. Intellectual Property
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, and software, are the exclusive property of Hearo or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any part of the Service without our prior written consent.
9. Privacy
Your use of the Service is also governed by our Privacy Policy: https://www.hearo.website/privacy
By using the Service, you consent to our collection and use of your information as described in the Privacy Policy.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Hearo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising out of or related to these Terms or the Service shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Hearo and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Sections 4, 8, 10, 11, 12, and 14 of these Terms will survive termination.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the effective date at the top of this page and, where appropriate, notify you through the Service or via email. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.
